ENR 1.12 INTERCEPTION OF CIVIL AIRCRAFT


The air traffic rules and procedures in use in Brazil conform to Annexes 2 and 11 to the Convention on International Civil Aviation, and to the information contained in the Procedures for Air Navigation Services – Rules of the Air and Air Traffic Services and Regional Supplementary Procedures applicable to the SAM Region, except for the differences listed in GEN 1.7 and the following information:

1 INTERCEPTION PROCEDURES

1.1. The interception of civil aircraft shall be avoided and shall only be carried out as a last resort. However, the Aeronautical Command has the prerogative to intercept any aircraft, at the discretion of the air defense units or the authorities responsible for the execution of air defense missions.

Note: The word “interception”, in this context, does not include intercept and escort service provided, on request, to an aircraft in distress, in accordance with the Search and Rescue Manual (ICAO Doc. 7333). 
 
1.2. An aircraft which is intercepted shall immediately:

a) follow the instructions given by the intercepting aircraft, interpreting and responding to the visual signals according to the  specification of ENR;

b) notify, if possible, the appropriate ATS unit;

c) attempt to establish radiocommunication with the intercepting aircraft or with the appropriate intercept control unit, by making a general call on frequency 121.50MHz, giving the identification and type of the flight;

d) if equipped with SSR transponder, select Mode A code 7700, unless otherwise instructed by the appropriate air traffic services unit.


 
1.3. If any instruction received by radio from any source conflict with those given by the intercepting aircraft by visual signals, the intercepted aircraft shall request immediate clarification while continuing to comply with the visual instructions given by the intercepting aircraft.

1.5. If during the interception, radio communication is established, but a common language is not possible, any necessary information and instruction transmitted and received shall be transmitted by phrases and pronunciation mentioned next,repeating twice each phrase:

AVIÕES:

DIA - Recolher o trem de pouso ao passar sobre a pista de pouso a uma altura entre 1000 e 2000 pés acima do nível do aeródromo e continuar circulando o aeródromo.

NOITE - Piscar os faróis de pouso ao passar sobre a pista de pouso a uma altura entre 1000 e 2000 pés acima do nível do aeródromo. Se impossibilitado de piscar faróis de pouso, piscar outras luzes disponíveis.

O aeródromo indicado é inadequado.


DIA ou NOITE - Se é desejado que a aeronave interceptada siga a aeronave interceptadora até um aeródromo de alternativa, a aeronave interceptadora recolhe o trem de pouso e utiliza os sinais da Série 1, previstos para as aeronaves interceptadoras.

Se for decidido liberar a aeronave interceptada, a aeronave interceptadora utilizará os sinais da Série 2, previstos para as aeronaves interceptadoras.

DAY or NIGHT - If it is desired that the intercepted aircraft follows the intercepting aircraft to an alternate aerodrome, the intercepting aircraft raises it’s landing gear and uses Series 1 signals, prescribed for intercepting aircraft. 2 DETERRENCE SHOT LAW

2.1. The Brazilian Government based on Article 84, item IV of the Brazilian Constitution and considering paragraphs 1st, 2nd and 3rd from the Article 303 of Law nr 7.565, dated 19 December 1986, establishes the procedures to be followed concerning any hostile aircraft or aircraft suspected of smuggling illegal drugs, considering that such drugs may represent a threat to the public safety, as follows:
2.1.1. An aircraft is considered suspect of smuggling illicit narcotic drugs and psychotropic substances when one of the following conditions exist:

a) aircraft enters the national territory, without an approved Flight Plan, coming from regions known to produce or distribute illicit drugs; or

b) aircraft fails to identify itself to the air traffic control units or refuses to accomplish the determinations of the respective units if it is
following a route usually used for illicit drugs trafficking.
2.2. The aircraft included in 2.1.1 shall be subject to the following coercive measures: inquiry, intervention and persuasion. They will taken in sequence whenever the previous measure is not well succeeded, and conducted by the interceptor aircraft, with the purpose of compelling the suspected aircraft to land at the indicated aerodrome and to be submitted to the control measures on the ground, by the Federal or State police authorities.
2.2.1. The inquiry measures are used to determine or confirm the identification of the aircraft or, even, to watch its movements. They consist of a conspicuous approach to the intercepted aircraft, with the purpose of requesting information through radio  communication or visual signals, in accordance with the air traffic rules, which must be compulsorily known by airmen.
2.2.2. The intervention measures follow the inquiry measures and consist of demainding the intercepted aircraft to change its route with the purpose of forcing its landing at the aerodrome determined by the authorities, to be submitted to the control measures on the ground.
2.2.3. The persuasion measures follow the intervention measures and consist of warning shots, with tracer ammunitions, by the  interceptor aircraft so that the aircrew of the intercepted aircraft observe them with the purpose of convincing them to obey the
transmitted orders.
2.3. The aircraft suspected of smuggling illicit drugs that fails to respond to the coercive procedures described above will be considered hostile and subject to destruction measures.
2.4. The destruction measure is a last resort, condected by the interceptor aircraft, which opens fire against the hostile plane, with the purpose of damaging it and preventing it from proceeding the flight, and should be used after all procedures have been taken, to avoid the loss of innocent people’s lives.
2.5. The destruction measure must follow the conditions below:

a) it will be submitted to the operational control of the Aerospace Operations Command of the Air Force Command - COMAE;

b) all communications or images of the used procedures must be recorded in videotape; 

c) it will be executed by qualified Air Defense pilots and controllers, according to the standards established by COMAE;

d) it will be executed over impopulated areas where there are routes presumably used by drugs traffickers; and

e) It will be authorized by the Brazilian President or his delegated authority.
2.6. The present Decree must be divulged, before
coming into force, by the Brazilian Aeronautical
Information Publication (Brazilian AIP), destined to
airmen that must be familiar with its contents for
the air activity within the Brazilian Airspace.
2.7. The authorities responsible for the procedures
concerning the accomplishment of the destruction
measure shall answer, within the limits of their
attributions, for their acts, whenever their conduct
show any excess or abuse of power.
2.8. The procedures prescribed in this Decree must be
submitted to periodical evaluation, to be improved.
2.9. The Commander of the Air Force has the competence to authorize the execution of the destruction measure.
2.10. The Defense Minister, through the Aeronautical Command, must adjust all internal documentation with the standards prescribed in this Decree.
